In a country governed by the rule of law, every action that carries legal consequences must be based on proper legal regulations. This applies to establishing a Start-Up in Indonesia as well.
To be recognized as a legally operating Start-Up in Indonesia, a company must have a solid legal foundation. This includes adhering to laws such as Law No. 11 of 2008 on Information and Electronic Transactions, Law No. californialawyerusa.com/guest-post-write-for-us-law, and Presidential Regulation No. 74 of 2017, which outlines the National E-Commerce Roadmap.
Additionally, several permits and licenses are required for the legal establishment of a Start-Up. Key documents include:
Trade Business License
This license is a must for companies involved in commercial activities. The application process is governed by Government Regulation No. 24 of 2018 regarding Online Single Submission (OSS), which is an integrated electronic licensing service.
To obtain a SIUP, you’ll need to provide documents such as the Deed of Establishment, Identity Card, Taxpayer Identification Number (NPWP), business location permit, and your company's financial statements.
Taxpayer Identification Number
The NPWP relates to the company’s tax obligations. Start-Up companies are required to file annual tax returns each year. This requirement is clearly stated in Law No. 28 of 2007, floridalawyerusa.com which amended Law No. 6 of 1983 concerning General Provisions and Procedures for Taxation.
Meeting these legal requirements ensures that your Start-Up operates smoothly within the law, allowing you to focus on growing your business.
